1. Who we are

These Terms & Conditions ("Terms") are an agreement between you and PsychonautEx Initiative ("we", "us", "our"). PsychonautEx Initiative is operated by Trinocular Media AS.

Public-facing teaching and writing may appear under the name Alan Michael Houot.

In these Terms, the "Services" means psychonautexinitiative.com (the "Site"), our course and sales pages, emails, downloadable materials, guided audio, podcast episodes, courses, memberships and community spaces.

2. Agreeing to these Terms

By visiting the Site, downloading a lead magnet, joining an email list, buying a product or joining a community space, you agree to these Terms and to our Privacy Policy. Please read them carefully. If you do not agree, do not use the Services.

We may update these Terms. We will post the current version on the Site with a new effective date. If you keep using the Services after a change, you accept the updated Terms, except where the law requires us to ask for your consent again. Please check this page from time to time.

3. What PsychonautEx Initiative is, and what it is not

PsychonautEx Initiative is a teaching programme. We offer educational and teaching content, information, and research on the exploration and documentation of visionary perception in altered states, elicited by but not limited to psychedelics. Our focus is calm, disciplined exploration of inner territory and how to integrate intense experiences afterwards. Content includes checklists, audio, courses, emails, podcast episodes and community discussion.

The Services are for education and personal reflection only. They are not:

  • medical, psychiatric, psychological or psychotherapeutic advice, diagnosis or treatment;
  • a crisis service, emergency line or substitute for a licensed clinician;
  • legal advice about any substance, ceremony, retreat or jurisdiction;
  • an invitation, instruction or encouragement to obtain, possess, or use any controlled substance.

You are responsible for your own health decisions and for obeying the laws that apply to you. If you are in distress, contact your local emergency services or a qualified professional. Do not rely on our materials in a medical emergency.

Controlled substances

By using the Services, you acknowledge and understand that psychedelics are listed as Schedule I of the United States Controlled Substances Act. Moreover, each country in the European Union abides by their own regulations on narcotics and psychotropics. In Norway, for example, psychotropics are listed in the Narkotikalisten (The Narcotics List).

Under the federal laws of the United States of America, manufacturing, distributing, selling, dispensing or possessing psychedelics is illegal, and people can be arrested and/or prosecuted for doing so. You also acknowledge and understand that psychedelics are controlled substances under applicable state laws, and that under those laws manufacturing, distributing, selling, dispensing or possessing psychedelics is illegal and people may be arrested and/or prosecuted for doing so. Similar or stricter rules apply in many other countries.

Nothing in the Services should be read as encouraging or promoting any prohibited activity involving controlled substances.

4. Website and promotional material disclaimers

This content is not intended to be a substitute for professional legal or medical advice, diagnosis or treatment. Always seek the advice of your physician or other qualified health provider or legal counsel with any questions you may have about a medical condition or legal situation. Never disregard professional medical advice or delay in seeking it because of something you have read on this website. This website does not encourage the illegal use of controlled substances.

5. Who may use the Services

The Services are for adults only. You must be at least 21 years old. If the country where you live sets a higher age for this kind of content, that higher age applies. The Services are not intended for minors.

You confirm that the information you give us is true and accurate to the best of your knowledge, and that you will keep your account details confidential. You are responsible for activity under your login.

6. Where you use the Services

We make no claim that the Services or their content are accessible or appropriate outside Norway. Access to the Services may not be legal for certain people or in certain countries. If you access the Services from elsewhere, you do so on your own initiative and you are responsible for following local laws.

7. Privacy and use of information

Your use of the Services is also governed by our Privacy Policy, available at psychonautexinitiative.com. We may use information about your use of the Services, and information you give us, only in the ways described in our Privacy Policy. 

8. Lead magnets, email and accounts

Free materials such as the "Your First Day Back" checklist and companion audio may be offered in exchange for your email address. Delivery may be split, for example the checklist on a thank-you page and the audio after you reply to the first email.

We may send operational messages needed to deliver what you asked for. We send marketing email only where we have a lawful basis to do so, and you can unsubscribe at any time.

9. Courses, memberships and your licence

Paid courses, memberships and community access are licensed, not sold. We grant you a limited, personal, revocable, non-transferable, non-exclusive licence to use the Services and their content for your own learning, during the access period stated at checkout.

You may not:

  • share logins, or resell, republish, distribute, assign, sublicense or sell our materials;
  • prepare derivative works from our materials, or copy them into another product, course or public site without our written permission;
  • publish course videos, scripts or worksheets;
  • reverse engineer or break into the Site or the platforms we use;
  • use our materials, products or services in breach of any law.

You may download materials we give you for your personal use.

10. Community and user content

If we run a community, comments or live sessions, you keep ownership of what you post. You grant us a limited licence to host, display and moderate that content so the community can function.

Do not post:

  • requests or offers involving illegal activity;
  • detailed guidance on obtaining or manufacturing controlled substances;
  • other people's private information, session notes or identifiable health details;
  • harassment, hate, sexual content, spam or scraping.

We may remove content or close accounts that break these rules. We do not undertake to monitor every post.

11. Following the law

You agree to follow all laws that apply to your use of the Services.

12. Ownership, intellectual property and trademarks

All content in the Services, including the PsychonautEx Initiative name, "Signal-First Field Guide" language, course structure, checklists, audio scripts, page design and other materials, is and will remain the property of PsychonautEx Initiative under its owner company Trinocular Media AS or its content suppliers and licensors, and is protected by copyright, trademark and other rights. Alan Michael Houot's books and published writing remain subject to their own copyright notices.

All marks, related names, logos, product and service names, designs and slogans of PsychonautEx Initiative are its trademarks. You must not use them without our prior written permission. All other names, logos, product and service names, designs and slogans in the Services are the trademarks of their respective owners.

Using the Services does not give you any ownership rights in any content.

13. Payments, refunds and access

Prices are shown at checkout and payments may be processed by a third-party provider (for example Stripe via Kajabi). Refund rules are stated on the sales page for each offer. If none are stated, any mandatory consumer rules that apply to you still apply.

We may suspend access if a payment fails, if these Terms are broken, or if we must take a product offline. We will try to give reasonable notice where the law allows.

14. Third-party tools and links

The Services may run on Kajabi and use email, analytics, payment and hosting providers. Those providers have their own terms. We are not responsible for third-party sites we link to.

15. Disclaimer of warranties

The Services and all information in them are provided "as is" and "as available". You use the Services at your own risk. To the fullest extent the law allows, we disclaim all warranties of any kind, including express, statutory and implied warranties of merchantability, fitness for a particular purpose, non-infringement and uninterrupted or error-free operation. If your jurisdiction does not allow limits on warranties, this limit may not apply to you.

Nothing in our content guarantees a particular psychological outcome, "solid ground" or any health result. Results vary.

Nothing in the Services shall be read as encouragement or promotion of any prohibited activity involving controlled substances.

16. Limitation of liability

To the fullest extent the law allows, PsychonautEx Initiative and Trinocular Media AS, its affiliates, directors and Alan Michael Houot are not liable for any indirect, incidental, consequential (including loss of business, lost profits or litigation), special, exemplary or punitive loss or damage, under any legal theory, arising out of or relating to the Services, your use of them, or your reliance on educational content, even if we were told such loss was possible.

Where liability can be limited, our total liability for any claim is limited to the amount you paid us for the relevant product in the 12 months before the claim, or if you used only free materials.

You may have additional rights under certain laws (including consumer laws) that do not allow implied warranties to be excluded, or certain damages to be excluded or limited. If those laws apply to you, the exclusions or limits in these Terms that directly conflict with them may not apply to you. Nothing in these Terms limits liability that cannot be limited by law, including liability for intent or gross negligence, or your statutory consumer rights.

17. Indemnity

You agree to indemnify, defend and hold harmless PsychonautEx Initiative and/or Trinocular Media AS and our partners, employees and affiliates from any liability, loss, claim and expense, including reasonable legal fees, arising from your misuse of the Services, your user content, or your breach of the law or these Terms, except to the extent a claim is caused by our intent or gross negligence.

18. Suspension and termination

You may stop using the Services at any time. We may suspend or end your access, or end this agreement, if you breach these Terms, if the law requires it, or if we discontinue a product.

Sections that by their nature should survive (including intellectual property, disclaimers, liability limits, indemnity and governing law) survive the end of this agreement.

19. Governing law and disputes

These Terms, and any dispute between you and PsychonautEx Initiative or its affiliates, are governed by the laws of the Municipality of Oslo in Norway, without regard to conflict-of-laws rules. Any legal suit, action or proceeding arising out of or relating to these Terms or the Services shall be brought exclusively in the Municipality of Oslo, and you and PsychonautEx Initiative both submit to the jurisdiction of its courts.

We would rather resolve any concern with you directly first, so please contact us.

20. General

Severability. If a court of competent jurisdiction finds any part of these Terms unenforceable or invalid, that part will be limited or removed to the minimum extent necessary, and the rest of these Terms will remain in full force.

No waiver. If we do not exercise or enforce a right under these Terms, that is not a waiver of it. Any waiver by us must be in writing and signed by an authorized representative of PsychonautEx Initiative.

Relationship. Nothing in these Terms or your use of the Services makes either of us a partner, joint venturer, employee or agent of the other. Neither of us may create any obligation in the other's name.

Entire agreement. These Terms, together with our Privacy Policy and any additional terms, policies, guidelines or rules posted for a specific product or space, are the entire agreement between you and PsychonautEx Initiative about the Services. They replace any earlier communications or proposals about the Services.
